USE OF THE WEBSITE
By using our website you are agreeing to comply with and be bound by the following terms and conditions of use, which govern Chocolate Wishes® relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website. This website remains under copyright to us at all times. Chocolate Wishes® is a registered Trade Mark.
Your personal data will never be passed on to a third party.
It shall be your responsibility to ensure that any products you choose meet your own specific requirements.
Where external links are provided this does not imply that we endorse the website(s) nor do we accept responsibility for the content of the linked website(s).
The use of the term ‘days’ refers to working days (Monday to Friday inclusive) and excludes national holidays and bank holidays.
Prices and Delivery (UK)
Up to date prices are listed on the website. If you require larger quantities for specific events we may be able to offer a discount. In this instance please contact us before placing your order. Please note that Royal Mail has advised that parcels can be opened at random if they appear ‘suspicious’. We have been unable to obtain reassurances that our packages will not be subjected to random checks, so would advise you select the option to have your parcels delivered by courier unless you require them quicker and accept at your own risk Royal Mail opening your parcel.
Your order will be sent to the address you have provided and it is your responsibility to ensure you have provided accurate postal details including postcode. Alternative delivery addresses can be provided for the delivery of gifts, but again it is your responsibility to provide accurate postal address details and postcode. We reserve the right to alter your delivery method should we decide to do so to either ensure you receive your chocolate for a particular date/occasion ie to ensure festive/seasonal products arrive in time, or for any other reason which will ensure you receive a good service from us.
Should Royal Mail or our courier service be unable to deliver to you, for example if you are not in when they call (eg a card is left but the goods not collected nor a further delivery arranged ) then the postal service/courier will either destroy the goods or return them to us. Any goods returned to us by courier will incur a charge which will in turn will be passed on to you. We will charge £6.00 for any returned goods plus an additional charge to repost if the goods are still required. Our liability does not cover goods which cannot be delivered.
Delivery Times (UK)
We will normally despatch your order between 5 to 7 days of receipt of your order. NB: At busy times, holiday periods or over bank holidays and national holidays there may be a longer despatch date. From September/October our delivery can take up to 14 days due to the increase in seasonal orders. As Christmas nears this time can double as order volume increases. Again from February until after Easter our delivery can take up to and exceed 21 days. We will always do our very best to accommodate any deadlines you may be working to, so please email us to alert us to any time sensitive order. We shall notify you when your goods have been despatched.
Orders are accepted from overseas (non UK) if you can make online payment with a valid credit or debit card. For details of postal charges overseas please see the prices quoted online before checkout, as the cost of delivery will depend on your geographical location. Placing your order indicates acceptance of the postal charges, You must observe and comply with import and other permits of your country to purchase from our website. Nut Free Chocolate People accept no liability in respect of the export or import of the products you purchase.
Returns & Refunds
Your right to return goods are currently protected under the EU Distance Selling Directive. We have very high standards for the production of our goods and expect them to be delivered in a good condition. Whilst we have no control over our product once it leaves our premises, we will offer a refund or replacement for goods that have not been received after 14 days of despatch (this does not include items which have not been delivered due to the customer being away from home/work when delivery was attempted). Should this occur, please contact us with your order details so we can track your goods and replace/refund as appropriate.
Should you feel any of our products has not been to the standard you would expect, then please return the product to us and we shall issue you with a refund or a replacement. Any goods returned must be unopened, in the original packaging. We cannot be responsible for any items that do not reach us so please retain proof of posting.
We reserve the right to substitute items should the item ordered not be in stock. Should this be the case we will offer goods of a similar nature or a more expensive substitute, for example if you order a box of six chocolates we may substitute a box of 12. If we cannot offer a comparable product we shall contact you to discuss alternatives, or alert you to a delay in processing your order.

Nuts and Allergen Assurances
Written assurances are obtained from suppliers that all ingredients, packaging, ribbons and bubble wrap etc are free from peanut and tree nuts and nut traces, including being free from the use of nut oils on production machinery. Should allergen information not be available, this will be clearly stated on the website with the product information. Our assurances of the products being free from nuts and nut traces can only apply on our premises. We do not have any control over what may happen to our packaging once it is in transit, so we strongly advise that outer packaging is disposed of immediately and that hands are thoroughly washed before eating the chocolates or unwrapping the inner packaging. Nor do we have any control over the conditions our chocolates are stored in once they leave our premises. Our chocolates should be stored at a cool temperature (between 53.6°F and 64.4°F) and away from strong odours.
During particularly hot weather we cannot guarantee that our delivery service will keep your chocolates in these conditions. We will do everything we can do protect our chocolates from warm weather conditions and will carefully package with an extra layer of bubble wrap, but please appreciate that we cannot control extremes of temperature outside our premises. During times of extreme heat we will not despatch any goods, but will wait until temperatures fall to below 80°F.
Your information will be treated as confidential and shall only be used by Chocolate Wishes to process your orders and to keep you informed of any of our products or services we think may be of interest to you, if you have agreed to have this sent to you. We take data protection and security extremely seriously and shall not pass your details on to a third party. By using our website you agree to your information being used as stated above.
For your privacy, order information will be available to Chocolate Wishes and the named customer, not to any third party.
Our website, its content, our name and our product names remain our intellectual property. Chocolate Wishes® is a registered Trade Mark and as such is protected under Intellectual Property legislation.
